1. Program and eligibility
The WGR Referral Partner Program is for approved independent referral partners who introduce legitimate trade contractors with unpaid business-to-business commercial accounts. Consumer or household debts are not eligible. WAR Group Recovery LLC (WGR) may accept or decline any application or referral in its discretion.
2. Eligible referral
An Eligible Referral must be registered with WGR before WGR has an active relationship or documented prior contact with the referred company. The referral must be submitted with accurate business contact information and the referred contact's permission to share it. If more than one partner refers the same company, the first complete referral accepted by WGR controls.
3. Commission
An approved partner earns 2% of Eligible Recovered Funds collected by WGR for the referred company during the first 12 months after that company signs a WGR client agreement. There is no cap on the number of companies a partner may refer. Total commission is capped at $5,000 per referred company unless WGR agrees otherwise in writing.
4. Eligible Recovered Funds
Eligible Recovered Funds means cleared cash actually received and retained by WGR on eligible commercial collection matters. It excludes refunds, reversals, chargebacks, taxes, court costs, filing fees, legal fees, third-party expenses, amounts credited or written off, and funds later returned.
5. Retention and payment
Commission becomes payable only after the applicable recovered funds have remained cleared and unreversed for 30 calendar days. Approved payable commissions are processed on WGR's regular payment cycle. No payment is due until the partner has supplied a completed Form W-9 and any other reasonably required payment information.
6. Partner role and restrictions
A partner only makes introductions. A partner may not collect debts, negotiate settlements, give legal advice, quote binding fees, make guarantees, sign for WGR, receive debtor payments, use WGR branding without approval, or represent that the partner is an employee, agent, attorney, or collection representative of WGR.
7. Compliance and consent
Partners must use truthful, lawful outreach, honor privacy and marketing rules, and refer only business/commercial matters. Partners must have permission to share each referred contact's business information. Do not upload invoices, account statements, Social Security numbers, bank data, or debtor documents through the referral form.
8. Taxes and independent status
Partners are independent contractors and are responsible for their own taxes, licenses, expenses, and insurance. WGR will issue any tax forms required by then-current law. Participation does not create employment, partnership, agency, franchise, or joint venture.
9. Records, disputes, and audit
WGR's collection and payment records determine eligible amounts absent manifest error. A partner must report a commission question within 60 days after the related statement. WGR may withhold or reverse amounts connected to fraud, inaccurate information, duplicate referrals, refunds, or program violations.
10. Term and changes
Either party may end participation at any time by written notice. Ending participation does not eliminate properly earned commissions on referrals accepted before termination, subject to these terms. WGR may change or discontinue the program prospectively by posting revised terms; material changes do not retroactively reduce commissions already earned.
11. Confidentiality and privacy
Partners must protect nonpublic information received through the program and use it only for the referral relationship. WGR handles submitted information under its Privacy Policy. Portal access credentials and Case IDs must be kept confidential.
12. Governing law
These terms are governed by New York law, without regard to conflict-of-law rules. Any proceeding relating to the program must be brought in a court of competent jurisdiction located in Bronx County, New York, unless applicable law requires otherwise.
Acceptance and required documents
Applicants accept these terms electronically when applying. After approval and before the first payment, WGR should retain: the accepted application, these terms/version, a completed IRS Form W-9, payment instructions, and commission statements.
